Independent Contractor Misclassification

Some employers attempt to avoid paying overtime or reimbursing employees for expenses by improperly calling employees "independent contractors." Job titles alone, however, do not change the law, and many employees who are called independent contractors are really employees and entitled to all of the benefits and protections given to employees. Workers may be entitled to compensation if they were labeled as an independent contractor but the employer exerted a certain level of control over job duties, job schedule, the ability to work for others, and the necessary tools and equipment to do the job.
